Suwanee Land From Developer Lawsuit is Sold

Homebuilders reportedly plan a new residential development in the Moore Road area.

The tract of land in Suwanee that was the focus of a multimillion-dollar lawsuit involving the city has been sold, and the new developers plan to build houses in the Moore Road area.

A rezoning permit on file with the City of Suwanee says that Spartan Investors 1 LLC is seeking rezoning from R-140 to R-100 status. Also, the developers are requesting a special use permit that would allow construction of more than 7 homes, and the application says 61 homes are planned, according to Josh Campbell, planning and zoning director for the city.

There appears to be a connection between Spartan 1 Investors and the now-shuttered Bowen Family Homes company. Carter Richardson is listed on the city rezoning application, and his LinkedIn profile describes his company as Homesouth Communities (fka Bowen Family Homes).

The soonest that the rezoning application could come before the City Council would be at the July 23 meeting, Campbell said. The application is on the July 9 agenda for the city Planning & Zoning Commission.

This is the same 36-acre tract of land that had the city and Settles Bridge Farm LLC locked in a legal battle from 2008 until earlier this year. The Georgia Supreme Court sided with the city's appeal of a $1.8 million jury award to the developers.Β 

Notre Dame Academy of Duluth had sought to build a school on the property. But city officials, feeling residents in the area would object to such a development, enacted a moratorium and a special use permit to regulate development in the area.

The school never applied for the special use permit, and canceled its sales contract with Settles Bridge Farm LLC. That led to the legal battle.

The sale to Spartan Investors 1/Homesouth was completed last week, according to a spokesperson for Settles Bridge Farm LLC.

The new developers already have held a meeting with area homeowners, according to people familiar with the matter. But no reaction is known at this point.
